Under authority of the powers of sale and conveyance contained in that certain Deed to Secure Debt given by HERSCHEL HART ENTERPRISES, LLC to GLENNVILLE BANK, a Banking Corporation, dated February 2, 2016, the same being recorded in Deed Book 426, Pages 97-104, Emanuel County Records, conveying the after-described property to secure a Note dated July 29, 2024, executed by HERSCHEL HART, Manager, in the original principal amount of SEVENTY SIX THOUSAND ONE HUNDRED EIGHTY-EIGHT DOLLARS AND THIRTY CENT ($76,188.30), with interest thereon as set forth therein, there will be sold on the first Tuesday in January, 2026, within the legal hours of sale, before the Courthouse door in Swainsboro, Emanuel County, Georgia, at public outcry to the highest bidder for cash, the land conveyed in said security deed described as follows:
All that certain lot, tract or parcel of land situate and being in the 53rd G.M. District, Emanuel County, Georgia, designated as Lots #11 and 12 of Subdivision of Property of Bonnie F. Ogburn, Jr., fronting a distance of 240 feet on the western side of Atkinson Drive, as shown on plat of survey made by Aubrey E. Scott, Jr., Surveyor, dated February 28, 1980, which is recorded in the Office of the Clerk, Emanuel Superior Court in Plat Book 15, Page 620, which reference is made as a part of this description. Said property is bounded now or formerly as follows: north by Lot 10, of said subdivision, being the lands of Randall Roy Williford; east by Atkinson Drive; south by lands of donnie L. Hood and Lori V. Hood; and west by Lot #2, of said subdivision, being the lands of Jore J. Said property is subject to Restrictive Covenants dated October 27,1977, which are recorded in the

Said property is portion of that conveyed by a Warranty Deed dated October 26, 1977 from Robert E.

The indebtedness secured by said Deed to Secure Debt has become in default as to principal and interest because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed and the whole amount of said indebtedness is declared to be in default and immediately due and payable, and the above-described property will be sold for the purpose of enforcing payment of the indebtedness secured by said Deed to Secure Debt. A deed will be executed to the purchaser at said sale conveying title as authorized in said Deed to Secure Debt.
The proceeds of said sale will first be applied to the payment of the indebtedness to Ludowici Bank, other charges and the expenses of sale as provided in said Deed to Secure Debt including attorney’s fees (notice of intent to collect attorney’s fees having been given) and the excess, if any, as provided by law.
