Five sentenced in Superior Court

The following occurred during the Emanuel County Superior Court April 2024 term:

Charles Nathan Burgess, repeat offender, negotiated a guilty-alford plea on one count aggravated assault. He was fined $50 with 20 years probation, Rsat susp. for inpatient rehab; one count aggravated assault with 20 years probation, Rsat susp. for inpatient rehab; one count battery (FV) with 12 months probation; one count criminal interference w/govt property with 5 years probation. Defendant is sentenced for a total of 20 years to be served on probation. Defendant is to receive credit for time served in custody from 7/6/23 – 4/26/24. The above sentence may be served on probation provided the defendant shall comply with the Conditions of Probation imposed by the Court as part of this sentence. The Court sentences the defendant as a recidivist under O.C.G.A. § 17-10-7(c).

Donald Grier, repeat offender, negotiated a guilty plea on one count possession of cocaine. He was fined $50 with 3 years to serve; one count theft by shoplifting with 12 months to serve; one count possession of marijuana less than oz with 12 months to serve; one count possession of drug related objects with 12 months to serve. Defendant is sentenced for a total of 3 year. Defendant is to receive credit for time served in custody as determined by the custodian. The Court sentences the defendant as a recidivist under O.C.G.A. § 17-10-7(c). The defendant shall pay restitution in the amount of $12 through the Clerk of Court for the benefit of the victim(s).

Niko Gates negotiated a guilty plea on one count criminal attempt to commit a felony. He was fined $50 with 15 years to serve 5 years bal. probated; one count possession of a drug related object with 12 months to serve. Defendant is sentenced for a total of 15 years, with the first 5 years to be served in confinement and the remainder to be served on probation. Defendant is to receive credit for time served in custody as determined by the custodian. Upon service of 5 years, the remainder of the sentence may be served on probation; PROVIDED, that the defendant shall comply with the conditions of probation imposed by the Court as part of this sentence.

Ronald Ricks negotiated a guilty-alford plea on one count possession of meth. He was fined $50 with 3 years probation, enter inpatient rehab; one count theft by taking with 12 months probation; one count possession of marijuana less than oz. with 12 months probation. Defendant is sentenced for a total of 3 years to be served on probation. Defendant is to receive credit for time served in custody from 11/8/23 – 4/26/24. The above sentence may be served on probation provided the defendant shall comply with the Conditions of Probation imposed by the Court as part of this sentence.

Antwan Malik Early negotiated a guilty-alford plea on one count possession of firearm by convicted felon. He was fined $50 with 10 years probation, 150-180 PDC; one count obstruction of an officer with 12 months probation. Defendant is sentenced for a total of 10 years to be served on probation. Defendant is to receive credit for time served in custody from 4/2/24 – 4/26/24. The above sentence may be served on probation provided the defendant shall comply with the Conditions of Probation imposed by the Court as part of this sentence.
