The debt secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, failure to pay the indebtedness as provided for in the Note and said Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of sale, including attorney’s fees (notice of intent to collect attorney’s fees having been given).

The Georgia Department of Transportation (DOT) in coordination with the Federal Highway Administration (FHWA), is seeking feedback regarding the FHWA’s intention to issue a Section 4(f) de minimis (minor) impact finding for a bridge replacement project within George L. Smith State Park. A de minimis impact is one that, after taking into account avoidance, minimization, mitigation and enhancement measures, results in no adverse effect to the activities, features, or attributes qualifying a park, recreation area, wildlife or waterfowl refuge, or significant historic site for protection under Section 4(f) of the U.S. Department of Transportation (U.S. DOT) Act of 1966.

Georgia DOT has posted information at https://www.dot.ga.gov/GDOT/Pages/PublicOutreach.aspx related to the proposed bridge replacement at State Route (SR) 26 over Fifteen Mile Creek.

The existing bridge is approximately 240 feet long and 34 feet wide, with two 12-foot travel lanes and 2-foot paved shoulders. The existing speed limit is 55 miles per hour (mph). The existing right-of-way (ROW) width is approximately 100 feet. The proposed project would construct a new 275-foot-long bridge on the existing alignment and improve the roadway on both approaches to current Georgia DOT standards. The typical roadway section would consist of two 12-foot travel lanes (one in each direction) with 10-foot shoulders, of which 4 feet would be paved. The proposed bridge would also have two 12-foot travel lanes and 10-foot paved shoulders. The proposed speed limit would remain 55 mph. The proposed ROW width varies from approximately 100 feet to 150 feet. A temporary on-site detour would be installed on one side of the bridge to facilitate traffic flow while the existing bridge is removed, and the new bridge is constructed.

George L. Smith State Park is a 1,634-acre state park located in southern Georgia. The park contains a 412-acre lake; 10 cottages; 24 Tent, Trailer, and RV campsites, 4 picnic shelters, 1 conference center, 1 pioneer campground, a historic covered bridge and mill, and a playground. The park is used for a variety of recreation including biking, birding, boating, fishing, geocaching, hiking, picnicking, paddling, and kayaking and canoeing.

To construct the proposed project, approximately 77,101 square feet (sf), or 1.77 acres of ROW from George L. Smith State Park immediately adjacent to the bridge would be required. This ROW would be permanently converted from recreational park use to transportation use.

As a publicly owned park, George L. Smith State Park qualifies for protection under Section 4(f). As a result, Georgia DOT offer this notification per The Safe, Accountable, Flexible, and Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU), which requires that the public can review and comment before the FHWA can issue a de minimis (minor) impact finding under Section 4(f). The official with jurisdiction over the George L. Smith State Park concurs that the proposed project would have a de minimis impact.

The purpose of this internet posting is for the public to review and provide comments in order for the FHWA to issue a de minimis impact finding for the proposed project.

NOTICE OF LOCATION AND DESIGN APPROVAL

Notice is hereby given in compliance with Georgia Code 22-2-109 and 32-3-5 that the Georgia Department of Transportation has approved the Location and Design of this project.

The date of location and design approval is: February 26, 2025

The proposed project would replace the existing bridge at McGarrh Mill Pond Road over Daniels Mill Creek located in Emanuel County approximately 2.0 miles NW of the City of Summertown in Georgia Militia District 57 and 1208. The proposed bridge is 130-foot long and 28-foot wide gutter to gutter with a proposed roadway typical section that would consist of two 10-foot travel lanes (one in each direction) and 5-foot rural shoulders. The total length of the project is approximately 0.1 miles. An off-site detour will be used for the duration of the approximate 18 months of construction.

Georgia Dept. of Transportation would be responsible for acquiring property rights for this project.
